3. Scope and acceptance
3.1 These Terms apply to the relationship between the Provider and the User arising from the use of the App (including the Free Version and MeaUnda Premium) and of the Website, and to the offer of Premium Codes to Users on the Early-access list described in Article 7.
3.2 By signing up for the Early-access list, by installing or using the App, or by buying MeaUnda Premium or redeeming a Premium Code, you confirm that you have read these Terms and agree to be bound by them. If you do not agree with them, please do not sign up and do not use the App.
3.3 Where a provision of these Terms conflicts with a mandatory rule of Slovak or EU consumer law, the mandatory rule prevails and the rest of these Terms remains in force. Nothing in these Terms limits the statutory rights of a Consumer.
4. Pre-release status
4.1 At the time these Terms take effect, the App has not yet been released in the App Store. The Website is an information and pre-registration page.
4.2 The Provider does not guarantee any specific release date. Release depends among other things on Apple's review process, which the Provider does not control. Information about an expected release is an estimate, not a binding commitment, and does not constitute an offer within the meaning of § 43a of the Civil Code.
4.3 The functions, screens, parameters and prices presented on the Website, including what the Free Version and MeaUnda Premium contain, describe the App as it stands during development. They may still change before release. The binding price is the one shown in the App Store before the purchase is confirmed. The screenshots on the Website are illustrative.
4.4 Signing up for the Early-access list creates no obligation to pay anything and is not a purchase or a pre-order. It is a request to be informed, which you may cancel at any time. Receiving or redeeming a Premium Code under Article 7 does not oblige you to buy anything either.
5. Licence to use the app
5.1 Upon lawful acquisition of the App, the Provider grants the User a non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that the User owns or controls, for the User's own personal needs, for the duration of the App's availability. The licence to use MeaUnda Premium lasts, for a Subscription, while the Subscription (including any Free Trial) is active. The Lifetime Purchase has no expiry date and never renews: it lasts for as long as the App is offered in the App Store and, on a device where the App is already installed, also afterwards, for as long as Apple confirms the purchase on that device and the App keeps working there, subject to Article 5.3. The App contains no means for the Provider to switch MeaUnda Premium off remotely. MeaUnda Premium is linked to the Apple Account with which it was bought or obtained by redeeming a Premium Code.
5.2 The User must not, and must not allow a third party to: (a) copy, distribute, rent, lend, sell or sublicense the App or make it publicly available; (b) modify, translate, adapt or create derivative works from it; (c) reverse engineer, decompile or disassemble it, except to the extent expressly permitted by § 37 of Act No. 185/2015 Coll. (the Copyright Act) or by other mandatory law; (d) remove or alter any notice of authorship or ownership; (e) use the App in a manner that circumvents the safety warnings described in Article 10; (f) circumvent the limits or Promotional Screens of the Free Version or the verification of purchases, for example by altering the data the App stores on the device or by changing the device's clock.
5.3 The Provider may release updates of the App. Updates may add, change or discontinue individual functions, and the Provider may change the scope and the limits of the Free Version. The Provider is not obliged to maintain any particular function indefinitely. The Provider changes MeaUnda Premium only for a valid reason (such as new versions of iOS or of Apple's rules, security, legal requirements or technical feasibility) and at no additional cost to the Consumer. If a change would reduce MeaUnda Premium that a Consumer has paid for more than slightly, the Provider will announce it at least 30 days in advance on the Website and in an update of the App that shows the notice before the change takes effect, and the Consumer may end the contract free of charge within 30 days of the notice or of the change, whichever is later: a Subscription by cancelling it (Article 8.4); the Consumer may also ask Apple for a refund for the unused period or for the Lifetime Purchase (Article 9.3), and the Provider will support the request. The Provider will not remove a function that was the core reason for a paid purchase without offering the Consumer a proportionate remedy.
5.4 The App is licensed, not sold. Ownership of the App and all its components remains with the Provider.
6. Distribution via the App Store
6.1 The App is distributed exclusively through the Apple App Store. In addition to these Terms, Apple's own terms (in particular the Apple Media Services Terms and Conditions and the Licensed Application End User Licence Agreement) apply to the download, to any purchase (including Subscriptions and the Lifetime Purchase), to Free Trials and to the redemption of Premium Codes. Apple's terms are available at https://www.apple.com/legal/internet-services/itunes/ww.
6.2 Apple is not a party to these Terms. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Any claim relating to the App is directed at the Provider, not at Apple. Apple and its subsidiaries are third-party beneficiaries of this Article and may enforce it.
6.3 In the event of any failure of the App to conform to an applicable warranty, the User may notify Apple, and Apple may refund the purchase price of the App, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
6.4 The User represents that they are not located in a country subject to an EU, Slovak or U.S. embargo, and that they are not listed on any prohibited or restricted party list.
7. MeaUnda Premium Lifetime for the first 50 sign-ups (Premium Codes)
7.1 What is offered. The Provider gives a Premium Code, free of charge, to each of the first 50 Users who validly sign up for the Early-access list on the Website. The Premium Code unlocks the Lifetime Purchase of MeaUnda Premium at no charge.
7.2 How the order is determined. Each successful sign-up is recorded with a sequential number in the order in which it reaches the Provider's server. The first 50 sign-ups in that order that meet the conditions in Article 7.3 receive a Premium Code; a sign-up whose consent is withdrawn before the codes are sent does not count. The counter shown on the Website is informative and is updated when a sign-up is recorded.
7.3 Conditions. To qualify, a sign-up must: (a) contain a valid, working e-mail address that the person signing up is entitled to use; (b) include the consent to be contacted; and (c) be a first sign-up for that address (repeated sign-ups of the same address count once, under the number first recorded). Automated, duplicated, fictitious or otherwise abusive sign-ups do not qualify.
7.4 Delivery. The Premium Code is sent by e-mail to the signed-up address on or around the day the App is released in the App Store. The e-mail states the code and the information in Article 7.6, and may include Apple's own link for redeeming it. The Provider does not issue any code, link or other means of its own for unlocking MeaUnda Premium. If the message cannot be delivered (a non-existent mailbox, a full mailbox, or a rejection by the recipient's mail server), the Provider will try once more; if that also fails, the entitlement lapses. A code that lapses in this way is not passed to another User.
7.5 Redemption. The Premium Code is redeemed only through Apple: in the App Store, through Apple's redemption link, or in the App under Settings → Redeem code. Redemption requires an Apple Account, and Apple lets each Apple Account redeem only one code from this offer. A Premium Code can be redeemed only with an Apple Account for one of the countries or regions referred to in Article 7.6; a User whose Apple Account is for another country or region cannot redeem it, and the Provider cannot provide a substitute. After redemption, MeaUnda Premium is linked to that Apple Account.
7.6 Terms of the code. The following applies to every Premium Code:
- it expires on the date and at the time stated in the e-mail that delivers it and cannot be redeemed after that, so redeem it before then;
- it can be redeemed only in the countries and regions where the App is available in the App Store;
- an Apple Account is required, subject to prior acceptance of licence and usage terms;
- it is not for resale and has no cash value;
- full terms apply; see https://www.apple.com/legal/internet-services/itunes/ww;
- the offer and content are provided by MeaOvis s. r. o.
7.7 Nature of the entitlement. The Premium Code is provided free of charge, is personal and non-transferable, cannot be sold or exchanged for money or any other consideration, and cannot be combined with other discounts. It is not a prize in a lottery or a similar game within the meaning of Act No. 30/2019 Coll., as it does not depend on chance and no stake is paid. Keep the code private: whoever enters it first can redeem it. The Provider cannot see who redeemed a code and is not obliged to replace a code that was redeemed by someone else, was lost, or was not redeemed before it expired.
7.8 What the code gives. A redeemed Premium Code provides the Lifetime Purchase at no charge. It does not renew, never converts into a paid Subscription, and nothing is charged for it; the Provider never asks for payment details. MeaUnda Premium obtained in this way lasts as set out in Article 5.1 and can be restored on other devices signed in to the same Apple Account (Article 8.6). Redeeming a Premium Code does not cancel a Subscription that is already active; that Subscription keeps renewing until it is cancelled in the Apple Account settings (Articles 8.4 and 8.5). If you already own the Lifetime Purchase, redeeming the code adds nothing, and the Provider cannot refund the price you paid for it (refunds are handled by Apple, Article 9.3).
7.9 Changes to the offer. The Provider may extend the offer, or end it early, if a serious reason requires it (in particular abuse of the sign-up form or a technical fault). Doing so does not affect entitlements already validly acquired. Any change will be published on the Website. The delivery of Premium Codes depends on Apple's offer-code programme, whose availability and limits are set by Apple; if Apple does not make the codes available, the Provider will inform the Users concerned by e-mail. Apple may also deactivate codes that were already sent, for example if the App is removed from the App Store; the Provider will then inform the Users concerned by e-mail, but it has no other means of unlocking MeaUnda Premium.
7.10 The offer is not addressed to persons under 16 years of age.
7.11 Sign-ups made up to and including 11 September 2026. For Users who signed up on or before 11 September 2026, the Premium Code is how the Provider delivers the "Free Account" promised in the previous version of this Article; it gives at least what was promised there (free access to the full functionality of the App, which never converts into a paid subscription). The Provider will inform these Users of this change by e-mail without undue delay.
8. Prices and payment
8.1 The Free Version. The Website, signing up for the Early-access list, downloading the App and using the Free Version are free of charge. In the Free Version: (a) speaker cleaning can be used in full only a limited number of times in total (currently once), and sessions other than Sleep Noise and Delta 2 Hz, routines, focus tones in Work Mode and the Noise Detector can each be used in full only a limited number of times within a rolling period (currently once in any 7 days); Complete Clean, which ends with a speaker test, counts as speaker cleaning; a full use counts as soon as it starts, even if it is stopped early, while a preview, or a start that fails, uses nothing; (b) once a limit is reached, the App offers MeaUnda Premium or a short preview of the function, and the preview is preceded by a Promotional Screen; (c) the mosquito function, the Dog Whistle, Sleep Noise and Delta 2 Hz remain free without limits wherever they are started, but a Promotional Screen may be shown before one of them starts, currently at most once every 15 minutes, and any Promotional Screen shown restarts that interval; (d) the SOS beacon and the standalone Speaker Test are never limited and are never preceded by a Promotional Screen; and (e) Max mode is not available. The limits under (a), and when each function can be used in full again, are shown in the App under Settings. The limits apply to the device, not to the Apple Account, are recorded only on the device as described in Personal Data & GDPR, and may still apply after the App is reinstalled. Nothing is charged for a preview or a Promotional Screen.
8.2 MeaUnda Premium. MeaUnda Premium is offered (a) as a Subscription, monthly or yearly, or (b) as the Lifetime Purchase, a one-time purchase. The price, the billing period and any Free Trial are shown in the App and in the App Store before the purchase is confirmed, in the local currency and including VAT where applicable. Prices are set by the Provider and converted into local currencies by Apple.
8.3 Payment is made exclusively through Apple. Apple acts as the merchant of record; the Provider does not receive, process or store any payment card details. The receipt and any invoice are issued by Apple through your Apple Account.
8.4 Subscriptions and Free Trials. A Subscription renews automatically for the same period unless automatic renewal is turned off at least 24 hours before the end of the current period. Payment is charged to your Apple Account when you confirm the purchase or, with a Free Trial, when the Free Trial ends; each renewal is charged within the 24 hours before the current period ends. If you switch between the monthly and the yearly plan, the new plan starts when the current period ends. Where a Free Trial is offered, its length is shown before the purchase. Apple decides who is eligible; each Apple Account can use only one Free Trial of MeaUnda Premium, whether on the monthly or the yearly plan, and switching plans does not start a new one. When the Free Trial ends, the paid Subscription starts and the first period is charged, unless the Subscription is cancelled at least 24 hours before the Free Trial ends. A Subscription is managed and cancelled in the settings of your Apple Account (on iPhone: Settings → your name → Subscriptions), which the App also opens under Settings → Manage subscription while a Subscription is active; the Provider has no technical means of cancelling it for you. After cancellation, MeaUnda Premium remains available until the end of the current period or Free Trial, as shown in the App under Settings. Apple notifies subscribers of a price increase in advance and asks for their consent where required.
8.5 Lifetime Purchase. The Lifetime Purchase is a one-time purchase and never renews. If a Subscription is active (including one still in its Free Trial) when you obtain the Lifetime Purchase, for example by redeeming a Premium Code, the Subscription is not cancelled automatically and keeps renewing, as a paid Subscription once any Free Trial ends, until you cancel it (Article 8.4); the App points this out under Settings.
8.6 Apple Account and restoring purchases. MeaUnda Premium is linked to the Apple Account with which it was bought or obtained by redeeming a Premium Code. On another device signed in to the same Apple Account, or after reinstalling the App, it can be restored in the App under Settings → Restore purchases. The Provider cannot move MeaUnda Premium to another Apple Account.
9. Right of withdrawal (Consumers)
9.1 Signing up for the Early-access list involves no payment and no contract for the supply of goods or services; you can end it at any moment by unsubscribing, without any formality.
9.2 A Consumer who buys a Subscription or makes the Lifetime Purchase has, in principle, the right to withdraw from the contract within 14 days under EU consumer law (in Slovakia, Act No. 108/2024 Coll. on consumer protection). Because Apple sells MeaUnda Premium in the App Store as the merchant of record (Article 8.3), the right is exercised with Apple under the Apple Media Services Terms and Conditions, in particular through reportaproblem.apple.com, and Apple decides on it. Under the law, the right ceases to exist before the 14 days end only where the supply of digital content has begun with the Consumer's prior express consent, the Consumer has acknowledged that they thereby lose the right of withdrawal, and this has been confirmed to them. Cancelling a Free Trial at least 24 hours before it ends costs nothing.
9.3 Because purchases are made through the App Store, refund requests are handled by Apple through its own procedure (reportaproblem.apple.com). The Provider will support a justified request but cannot process a refund itself. Cancelling a Subscription stops future renewals but does not by itself refund the period already paid for. None of this restricts the Consumer's statutory rights under Article 12.
10. Safe and permitted use
The App deliberately produces loud sound. Read this Article before you use it: it is the part of these Terms that can actually affect your health and your device.
10.1 Do not hold the device to your ear. The water-eject tones are loud by design. Never place the device against your ear, head or another person's ear while a tone is playing, and never use headphones or earphones with the cleaning or mosquito functions.
10.2 Set the volume responsibly. The App needs a high system volume to work, and it tells you so. Nevertheless, prolonged exposure to loud sound can damage hearing. If the sound rattles or distorts, lower the output level from Strong to Standard or Gentle and switch off Max mode. Max mode is a separate MeaUnda Premium setting of the mosquito function: it plays at full output and louder than the selected output level would on its own. Stop immediately if you experience discomfort, ringing in the ears or pain.
10.3 The mosquito function is audible to some people and to animals. Children, teenagers and pets generally hear high frequencies far better than adults do. In Max mode the sound reaches down to 14 kHz at full output, so expect adults to hear it too. Do not use this function in a room with an infant, a child, a pet, or a person with hearing sensitivity, tinnitus, epilepsy or a hearing aid or cochlear implant. Do not use it in a shared or public space where others cannot avoid the sound.
10.4 Do not use the App to disturb, harass or harm. Using high-volume or high-frequency sound to annoy other people or animals may constitute an infringement or an offence. The User bears full responsibility for such use.
10.5 Do not use it while driving or in any other situation where the sound, or the attention it requires, could create a hazard.
10.6 Liquid damage. The App can help expel water and dust from the speaker grille. It cannot repair a device damaged by liquid and it does not make a device water-resistant. If your device has been submerged, switch it off, do not charge it, let it dry and contact an authorised service centre. Use of the App is not a substitute for professional service and does not extend or replace any manufacturer warranty.
10.7 The User is obliged to use the App in accordance with these Terms, with the warnings displayed in the App itself, and with the applicable law.
11. What the App is not
11.1 Not a measuring instrument. The Noise Detector produces an estimate of the sound level from a phone microphone. It is not a calibrated sound level meter within the meaning of the metrological rules, it is not a certified type of measuring instrument, and its readings must not be used to certify a workplace, to demonstrate compliance with noise limits, as evidence in proceedings, or as the basis of any claim.
11.2 Not a medical device. The App neither diagnoses nor treats anything and must not be used for any medical purpose, including the assessment of hearing.
11.3 Not a pest control product. The mosquito function is a deterrent based on pulsed high-frequency sound (15–20 kHz, and 14–21 kHz in Max mode). It is not an insecticide or a biocidal product, it does not kill insects, and its effect varies with the species, the environment, the acoustics of the room and the individual device. The Provider gives no guarantee of a particular result and the function is not a substitute for a mosquito net, a repellent or professional pest control, particularly in regions where mosquitoes transmit disease.
11.4 Not a repair service. See Article 10.6.
12. Defects and complaints
12.1 The Provider is liable for defects of digital content and digital services in accordance with Act No. 108/2024 Coll. and the Civil Code. The App must correspond to its description, be fit for its usual purpose, be supplied with the usual accessories and instructions, and be free of legal defects.
12.2 A Consumer may notify a defect at any time within two years of supply (or, where the content is supplied continuously, throughout the period of supply) by writing to app@meaovis.com and describing the defect, the device and the version of the App and of iOS.
12.3 The Provider will confirm receipt of the complaint without delay, decide on it as soon as possible and settle it within 30 days of the day it was made, unless a longer period is agreed with the Consumer. If the defect can be remedied, the Consumer is entitled to have it remedied; otherwise to a proportionate price reduction or to withdraw from the contract, under the conditions laid down by law.
12.4 The rights described above do not apply to defects caused by the User's own conduct, by use contrary to these Terms, by a modification of the device's operating system, or by hardware defects of the device itself.
13. Liability
13.1 The Provider is liable for damage it causes in accordance with the law. Nothing in these Terms excludes or limits liability for damage to health or life, for damage caused intentionally or by gross negligence, or any other liability that cannot lawfully be limited.
13.2 Beyond those limits, and to the extent permitted by law, the Provider is not liable for: damage arising from use of the App contrary to Articles 10 and 11; damage to hearing caused by disregarding the volume warnings; damage to the device's speaker caused by continued use at an output level at which the sound audibly distorts; consequences of existing liquid damage; the absence of a particular deterrent effect on insects; or decisions the User makes on the basis of the estimated decibel reading.
13.3 The App is provided "as is" as regards the accuracy of results that depend on the specific device, its speaker, its microphone, the acoustics of the environment and the version of iOS. The Provider does not warrant uninterrupted or error-free operation on every device or configuration.
13.4 Where the Provider's liability towards a User who is not a Consumer can lawfully be limited, it is limited to the amount that User actually paid for the App and MeaUnda Premium in the twelve months preceding the event giving rise to the damage, and does not cover lost profit or indirect damage.
14. Intellectual property
14.1 The App, its source code, user interface, graphics, icons, texts, sound patterns and the name MeaUnda, as well as the content of the Website, are protected by copyright and other intellectual property rights of the Provider or its licensors.
14.2 Nothing in these Terms transfers any of those rights to the User. Use beyond the licence in Article 5 (including copying the Website's texts or graphics for commercial purposes) requires the Provider's prior written consent.
14.3 Apple, App Store, iPhone, iOS and iPadOS are trademarks of Apple Inc. They are used here solely to describe compatibility.
15. Use of this website
15.1 The Website is provided for information purposes. The Provider endeavours to keep it available and accurate, but does not guarantee uninterrupted availability and may change or suspend it at any time.
15.2 The User must not interfere with the operation of the Website, in particular by attempting unauthorised access, overloading it, submitting automated or false sign-ups, or bypassing the protective measures of the sign-up form.
15.3 The interactive demonstrations on the Website (the tone preview, the sound-level meter and the pulse pattern simulator) run in the browser for illustration only. The tone preview plays a deliberately quiet sound; the meter uses the microphone only while you keep it running, and only with your browser's permission; the pattern simulator plays no ultrasound at all. Article 10 applies to them as well: keep the volume moderate and do not use headphones.
16. Personal data
Personal data is processed as described in a separate document, Personal Data & GDPR, which forms an integral part of the information the Provider gives the User. In short: the App sends no personal data to the Provider and shows no third-party advertising; to show prices and check purchases, iOS contacts Apple's App Store, and purchases and the redemption of Premium Codes are handled by Apple; the record of the Free Version's limits and of the last confirmed purchase is kept on the User's device, is never sent to the Provider and may remain on the device after the App is deleted; and we hold only the data connected with your sign-up on the Website (your e-mail address, the language you used, your place in the list, the record of your consent and any Premium Code sent to that address), short-lived server logs and any messages you send us.
17. Complaints and alternative dispute resolution
17.1 Please send any complaint first to app@meaovis.com. Most matters are resolved in a few messages.
17.2 If a Consumer is not satisfied with the way their complaint was handled, or believes that the Provider has infringed their rights, they have the right to turn to the Provider with a request for redress. If the Provider rejects the request or does not reply within 30 days of dispatch, the Consumer has the right to submit a proposal for alternative resolution of a consumer dispute under Act No. 391/2015 Coll.
17.3 The competent entities are the Slovak Trade Inspection (www.soi.sk) and other entities listed in the register kept by the Ministry of Economy of the Slovak Republic at www.mhsr.sk. The Consumer chooses which of them to address.
18. Governing law and jurisdiction
18.1 These Terms and any relationship arising from them are governed by the law of the Slovak Republic, in particular Act No. 40/1964 Coll. (the Civil Code), Act No. 108/2024 Coll. on consumer protection and Act No. 185/2015 Coll. (the Copyright Act), excluding conflict-of-law rules that would lead to another law.
18.2 Where the User is a Consumer resident in another EU member state, this choice of law does not deprive them of the protection of mandatory consumer rules of the state of their habitual residence, and they may bring proceedings in the courts of that state.
18.3 Disputes not resolved amicably are decided by the courts of the Slovak Republic having jurisdiction under the Code of Civil Procedure.
19. Changes to these terms
19.1 The Provider may amend these Terms, in particular upon a change to the App's functions, the Free Version or MeaUnda Premium, upon a change in the offer described in Article 7, or upon a change in the law. The current version is always published on the Website with its effective date. A change to the price of an existing Subscription is communicated by Apple, which asks for the subscriber's consent where required.
19.2 A change does not affect rights and obligations that arose before it took effect. Where a change materially affects Users, the Provider will inform them before the change takes effect: by e-mail where the Provider holds their address, and otherwise by a notice on the Website or in an update of the App.
20. Final provisions
20.1 If any provision of these Terms is or becomes invalid, ineffective or unenforceable, this does not affect the validity of the remaining provisions; the invalid provision is replaced by a provision the meaning of which is as close as possible to it.
20.2 These Terms are published in English and Slovak. The English version prevails in the event of a discrepancy, except in a relationship with a Consumer resident in the Slovak Republic, where the Slovak version prevails.
20.3 These Terms take effect on 11.09.2026.
